Evidence You Can Collect that Will Help You in Your Car Wreck Case

If you’ve never been involved in a car wreck, that’s great! But that also means that you may not know what evidence you can collect after a crash to help you in a lawsuit—whether brought by you or someone else. Several pieces of evidence will help you evaluate who caused the crash, and some of it can only be collected right away.

If you are well enough, make sure you get this information while at the scene of the accident:

  • photographs of the accident scene, the vehicles, the road, and traffic control or signs;
  • names and contact information of drivers, car owners, passengers, and witnesses;
  • locations of traffic control devices, such as traffic lights, stop signs, and road signs; and
  • notes of your own describing what you remember about the accident and documenting what others tell you about it.

If you are injured and cannot collect this information, do so as soon as possible after the crash or send a trusted friend or family member to do it for you.

Later, you can ask for or locate several types of records that you will need in the event of a lawsuit:

  • your insurance policy;
  • the police report, to show the basics of the crash, including driver, owner, and insurance information; weather information; and any traffic citations issued;
  • medical records, to show the extent of your injuries, diagnosis, and treatment;
  • medical bills, to show the money you had to pay as a result of your injuries;
  • salary and wage information, to show your pre-accident and post-accident earning ability, as well as any wages you lost due to the crash and your injuries; and
  • quotes and bills you received to get your car repaired.
